Expert
Testifies Gate That Killed Man at Dickies Arena Was Flawed |
|
An expert
has testified that an electronic gate that crushed a man outside Dickies Arena
in Fort Worth included a number of flaws. One of which, stated the expert, was
that the gate was equipped with safety features that could have prevented the
man's death but those features were defective or not properly used. The
lawsuit was filed against Trail Drive Management Corp., which is the nonprofit
organization that runs Dickies Arena for the city, by the victim's family.
Also named as defendants are two contractors that built the arena.

Truck Driver's Lawsuit Says He Was Forced to Drive Without Sleep |
|
A truck
driver working for Amazon who was involved in a crash alleges sleep
deprivation encouraged by his employer caused the accident. The driver has
filed suit against Amazon and its contractor, AAA Freight Inc., for negligence
and violations of federal drive-time laws. The case involves an incident on
Halloween in which the plaintiff crashed his tractor-trailer into a concrete
barrier. According to the complaint, the plaintiff was sleep-deprived because
his employer forced him to drive for long hours without a break, in violation
of federal law. The lawsuit alleges pain and suffering, mental anguish, loss
of earnings and medical care and is seeking more than $75,000 in
damages.

Residents Affected by Friday's Warehouse Explosion Begin Filing Suit |
|
Residents
near a warehouse explosion in Houston, Texas, last week have begun filing
lawsuits over damages to their homes. After multiple lawsuits were filed over
the Friday explosion, a judge approved a restraining order barring the company
from "changing, altering or destroying any tangible evidence" related to the
explosion. A 14-day injunction orders that the defense must preserve materials
that could be relevant in civil lawsuits. A follow-up hearing is scheduled for
Feb. 7.

Supreme
Court Advances Lawsuit Against Flint Officials Over Water Crisis |
|
The U.S.
Supreme Court will allow a lawsuit against officials in Flint, Michigan, to
move forward. The high court denied the defendants' motion to dismiss the
complaint, filed over the city's public health crisis involving the water
supply. Flint residents reported widespread cases of hair loss, skin rashes,
Legionnaire's disease, and lead poisoning after city officials changed the
water source from Lake Huron to the Flint River. The lawsuit was filed in 2016
by a woman whose child drank lead-contaminated water.

Victimâ??s Family Files Lawsuit |
|
The
family of Frank Flores, one of the two men who died in Fridayâ??s explosion at a
Spring Branch-area industrial facility, filed a wrongful death lawsuit in
Harris County District Court against Watson Grinding and Manufacturing. Nearly
200 Houston-area homes were damaged in the early morning blast and Flores, 44,
and his colleague Gerardo Castorena Sr., 45, died in the explosion.

Spine: Uber Said She Signed Her Rights Away |

Philadelphia
Common Pleas Court judge has ruled that, because Uber canâ??t prove that Jillian
Kemenosh actually read the companyâ??s terms and conditions before she signed up
or rode in the car that ran a red light, she canâ??t be forced to settle her
claims behind closed doors. Suffering a fracture to her spine, concussion, and
traumatic brain injury, Kemenosh sued Uber, its local subsidiaries, and the
driver, requesting a jury to determine her payout.

Carolina Hospital Facing Federal Lawsuit over Ransomware Attack |
|
A federal
class action lawsuit has been filed against Tidelands Health over a December
ransomware attack that crippled the South Carolina hospital's computer
systems. The lawsuit was filed last week by two patients who claim their
medical records and services were compromised in the incident. According to
the lawsuit, thousands of patientsâ?? highly sensitive medical records could
have been compromised in the attack.
