Lawsuit Over Va. Plant Explosion Set for Trial

A lawsuit filed over a 2010 explosion near Blacksburg, Va. at a plant is set to go to trial. The lawsuit was filed by three workers at the plant who were injured when the explosion destroyed an aluminum dust baghouse. The suit alleges that improper use and maintenance of the dust system led to the explosion which injured the three plaintiffs. Jury selection is scheduled for Monday in U.S. District Court in Roanoke.

Jury Selection Begins in Lawsuit for Man Injured at the Super Bowl

Jury selection started in Dallas this week for a lawsuit filed by a man who was injured by falling ice during the 2011 Super Bowl. The halftime worker suffered a "closed head injury," as well as "cognitive" and "emotional" injuries when ice fell from the roof of the Dallas Cowboys stadium. The lawsuit alleges that "the Dallas Cowboys and the stadium's architects failed to consider the potential danger of falling ice and snow." The trial is expected to last about a month.

Consumer Class Actions get Boost from U.S. Top Court

The Supreme Court gave consumers a victory on Monday by allowing them to proceed with class-action lawsuits alleging that millions of front-loading washing machines they bought suffered from mold or musty odors. By refusing to hear the appeals in three lawsuits, the court allowed claims against Whirlpool Corp, Sears Holdings Corp and a unit of Germany's BSH Bosch und Siemens Hausgeraete GmbH to move forward as class actions in lower courts. Business groups such as the U.S. Chamber of Commerce and the Association of Home Appliance Manufacturers had urged the Supreme Court to hear the companies' appeals.

Family of Blind Teen Settles Discrimination Lawsuit

The New Jersey family of a blind teenager has reached a settlement in a lawsuit filed against the boy's school alleging discrimination. The lawsuit alleged that blind students were not provided with "equal or proper opportunity to practice tests as they prepared for required standardized assessments." In the settlement, educational consortium Partnership for Assessment of Readiness for College and Careers agreed to make practice versions of standardized tests available to blind students beginning in spring 2014.

Health Group Wants Heart Attack Warning on Testosterone

 

A consumer advocacy group is calling on the FDA to add a bold warning label to popular testosterone drugs for men in light of growing evidence that the hormone treatments can increase the risk of heart attack. The group Public Citizen says the agency should immediately add a "black box" warning — the most serious type — to all testosterone medications and require manufacturers to warn physicians about a higher risk of heart attack, stroke and death with the treatments.

Family Files Malpractice Suit After Death of 6-Year-Old

Children's Medical Center of Dallas and one of their emergency room doctors are facing a malpractice lawsuit after the death of a 6-year-old boy. The lawsuit was filed by the family of the boy who died after he was misdiagnosed by an emergency room physician. The lawsuit alleges the defendants were "negligent and failed to diagnose [the boy’s] condition in a timely manner, failed to order appropriate testing, and misdiagnosed his condition, leading to [his] death."
