GOP Effort to Overturn Arbitration Rule at Risk From Republican Defectors |
|
A Republican-backed effort to overturn a rule making it easier for consumers to sue banks has hit a snag: the Senate. At issue is a Consumer Financial Protection Bureau rule approved in July barring fine-print requirements that consumers use arbitration to resolve disputes over financial services. The rule makes it easier for consumers to join class-action lawsuits against banks and credit-card companies. Though fiercely fought by the financial industry, it is set to go into effect in March.

Lawsuit: State Farm Directed Shoddy Hail Damage Repair |
|
A lawsuit was filed against State Farm Mutual Automobile Insurance Co., claiming it directed a Dallas collision center to make a money-saving but inadequate repair that ended up severely injuring a couple when their car was struck head-on. The federal lawsuit claims State Farm steered John Eagle Collision Center in Dallas into using an untested 3M panel bonding adhesive in place of Honda-specified welding to replace a hail-damaged steel roof several years ago. It's the second lawsuit in the case involving Matthew and Marcia Seebachan, who were severely injured when the roof gave way in a 2013 accident in Texas' Hill Country. The Murphy couple sued John Eagle in 2015 for the faulty repair. Pretrial testimony in that case prompted the State Farm lawsuit.

Insurance company Lloydâ??s of London is asking a judge to dismiss a lawsuit filed by a former Penn State linebacker who alleges that a knee injury cost him a shot at the NFL. The former athlete's lawsuit seeks $1.5 million from Lloyd's of London, which is accused in the lawsuit of failing to pay liability insurance after the athlete's ACL injury in 2016. The motion filed Friday in U.S. Middle District Court acknowledges that the plaintiff was injured, but denies the athlete's claims that the insurance company delayed the investigation and processing of the claim.
