The company said the contamination, which has been confined to gasoline in Chicago, Indiana and Wisconsin, was the result of incorrect molecular makeup of a small quantity of oil. The company has recalled 2.1 million gallons of gasoline from its Indiana refinery. The suit is $180,000 to cover the cost of corrective oral surgery the plaintiff needed, as well as pain and suffering. The plaintiff in the final suit was awarded $100,000 in damages for "false arrest and malicious prosecution." All in all, around 130 people arrested by the officer have been acquitted for DUI charges. But Dr. Larry Gentilello won’t be able to get compensatory payments from UTSW, a federal judge in Dallas has ruled. In granting UTSW’s motion to dismiss, Judge Ed Kinkeade wrote that the Supreme Court’s 2000 decision in Vermont Agency of Natural Resources vs. Stevens shielded state agencies from retaliation claims brought under the federal False Claims Act. They also claim that the hospital, Brownsville MD Ventures LLC, and five unidentified defendants have refused to pay them their wages and benefits following the terminations. The lawsuit indicates that as many as 50 people might have been terminated. EMMA PEREZ-TREVINO, Valley Morning Star 08/28/2012 | Read Article: Valley Morning Star | Appeals Court Upholds $5.2 M Verdict Against Dallas Doctor | | A Dallas doctor who lost a law suit filed by his receptionist this month must now also pay a patient who lost his limbs $5.2M because of negligence, a TX appeals court ruled. According to court documents, patient David Fritzgerald was admitted for surgery of an ulcer in 2003. However, the procedure caused him to contract pneumonia and gangrene and doctors had to amputate his arms below the elbow and his legs below the knee. Fritzgerald went to trial against Meenakshi Prabhakar, an infectious disease doctor; his Dallas-based practice, Infectious Disease Doctors PA; and the admitting physician, Richard Holmes. Meenakshi S. Prabhakar was found 100% liable and the jury handed down a $17 million penalty, reduced to $5.2 million because of a limit for statutory damages. The plaintiff says he was "subjected to a hostile work environment for more than a year" and had the religious beliefs of his boss forced upon him. The suit is seeking reinstatement, as well as back pay and compensatory and punitive damages.
