That’s the life Michelle Gaines leads today. A traumatic brain injury suffered in a devastating car wreck in 2006 robbed her of a healthy mind. Then, a jury in her community awarded her $8 million, before a court of appeals overturned it. Now, the Texas Supreme Court is refusing to hear the case."

Family of Injured UT Soccer Player Says Bars Overserved Hit-and-Run Suspect

Former downtown bar owner Yassine Enterprises is being sued by the family of a former University of Texas soccer player severely injured in an auto-pedestrian collision in February. The family of Kylie Doniak said in its lawsuit that Yassine bar Fuel, and Vice, owned by another company, overserved 22-year-old Nicholas Ray Colunga, who police say hit Doniak with his car while he was intoxicated. Doniak was left with severe physical and brain injuries after the crash.  Patrick George, Austin American Statesman  08/17/2012

Insurer on Defensive After Trying to Avoid $75K Payout

The Progressive Corp. insurance group is defending itself against an onslaught of negative publicity after it tried to avoid paying $75,000 to the family of a client killed in a car crash and tried to blame the wreck on her. The criticism began Monday with a blog post from 33-year-old Matt Fisher of Brooklyn, whose sister Kaitlynn Fisher had Progressive insurance and was killed in a June 2010 car crash in Baltimore. In order to avoid the payout to Kaitlynn Fisher’s family, Progressive interjected itself into a lawsuit the Fisher family filed against the other driver. Last week, a jury found the other driver negligent, despite Progressive’s efforts to persuade the jury otherwise.  Associated Press, The Washington Post  08/17/2012

1,500 Dodge Durago SUVs Recalled

Chrysler Group LLC has issued a recall of certain Dodge Durango SUVs due to a problem with the vehicles' air bag systems. The recall covers vehicles built from April 11 through July 20 and includes approximately 1,500 vehicles. The company said the vehicles' side air bags may not deploy during a side-end collision.  Jonathan Welsh, WSJ Blogs  08/16/2012

Feds Checking Nissan Versa Air Bag Problem

U.S. safety regulators are investigating the Nissan Versa subcompact car because an air bag may fail to inflate in crashes. The probe affects about 100,000 Versas from the 2012 model year.  TOM KRISHER, AP, Houston Chronicle  08/17/2012

Church Group Wants Wrongful Death Suit Dismissed

Joyce Meyer Ministries has asked that a wrongful death lawsuit against the organization over the death of a bodyguard's family be dismissed. The bodyguard killed his wife and two sons in 2009, and the lawsuit claimed the church ministry should have been aware of the man's plans in the months leading up to the murders. The organization provided marriage counseling to the couple before the murders, which lawyers say "means they had a duty to protect the family."  Nicholas J.C. Suit Filed Over Murder During Kickball Game

A lawsuit has been filed over a murder during a kickball game at Shawnee Park in Louisville, Ky., last August. The man killed was inadvertently struck by gunfire during a shootout. The suit names the company that hosted the event, saying it failed to provide adequate security in the park.  Jason Riley, Louisville Courier Journal  08/16/2012
