Suit Filed over Toxic Refinery Fire in California

Chevron has been hit with a lawsuit over a toxic refinery fire at the company's Richmond, Calif., plant. The suit, filed on behalf of eight residents who live near the plant, claim the fire was "avoidable" and that plant officials ignored the plant's "troublesome safety record." The residents say pollutants from the fire caused them health problems, including severe headaches, diarrhea and sore throats.  Justin Berton, San Francisco Chronicle  08/16/2012

Judge Reluctantly Tosses FBI Spying Lawsuit

A federal judge in California has tossed out a lawsuit against the FBI over alleged spying on an Orange County Muslim group. The judge said in his ruling that allowing the suit to go forward could result in information being disclosed that "compromised national security." In the lawsuit, the group contended that the FBI sent an undercover informant to spy on them, which is a violation of their constitutional rights.  Victoria Kim , LA Times  08/14/2012

Stage Owner Rejects Settlement Deal

The owner of the stage that collapsed at Indiana’s State Fair last year and killed seven people rejected a settlement plan Wednesday that would have protected the state from further legal action. Mid-America Sound officials said not enough of the victims had agreed to the deal. Of the 62 claimants, which include people who were injured and the estates of those who died, only 51 agreed to the settlement by the Aug. 1 deadline.  Associated Press, The Washington Post  08/16/2012

Dimock Township Agree to Settlement With Cabot Oil & Gas

Court documents filed this week indicate that residents in the tiny community of Dimock Township have agreed to a confidential settlement with Houston-based Cabot Oil & Gas Corp. Dimock became a flashpoint in the national debate over gas drilling and a technique called hydraulic fracturing, or fracking, after residents claimed in 2009 that Cabot polluted their water supply with methane gas and toxic chemicals and made some of them violently ill.  Associated Press, The Washington Post  08/16/2012

Officer Blamed for Death of Maryland Man

A wrongful death lawsuit has been filed against a Harford County, Md., sheriff's deputy over the death of a local man from atherosclerotic cardiovascular disease. According to the suit, the police officer arrived on the scene of a 911 call before paramedics to find a man performing CPR on the victim; the officer allegedly ordered the man to halt CPR, despite the fact that the victim was "responding favorably." The suit alleges that had the officer not stopped the CPR, the victim would have survived.  Allan Vought, Baltimore Sun  08/14/2012

FAMU Begins Settlement Process in Hazing Lawsuit

Florida A&M University has instructed its attorney to begin negotiating a settlement with the family of the drum major that was killed in a hazing incident on a school bus last fall. School trustees have not publicly discussed a specific settlement amount. Other defendants in the lawsuit - the charter bus owner and the bus driver - have requested the case be dismissed.  Denise-Marie Ordway, Orlando Sentinel  08/16/2012
