In the 4-3 ruling the state court ruled that Missouri’s cap on non-economic damages violates the state constitution’s right to a fair trial because courts would have to reduce such jury-awarded damages if they were larger than the state’s cap. Click on the headline and download the opinion. | Laws/Cases | | | Suit Filed Over Pepper Spray Incident in New York | | Three New Yorkers have filed a lawsuit against the NYPD and several officers after they were pepper sprayed during an Occupy Wall Street demonstration last September. The suit accuses officers of violating the plaintiffs’ constitutional rights, and one of the plaintiffs said he suffered painful side effects from the spray for weeks. No arrests were made at the scene. Bayer, based in Leverkusen, Germany, has resolved almost 1,900 cases in which it’s alleged that its Yasmin and Yaz contraceptives caused clots that can lead to heart attacks and strokes, the company said today in a stockholders’ newsletter. Bayer said it has paid $402.6 million in settlements of one category of clot cases, for an average of about $212,000 a case. The lawsuit accused the company of violating the Video Privacy Protection Act by "keeping records of videos watched by its customers for at least two years after they canceled." In the settlement, PokerStars will pay approximately $731 million, including paying off debts for Full Tilt Poker. The lawsuit was filed in April 2011, accusing the companies of "bank fraud, money laundering and illegal gambling operations." Samuel Rubenfeld, WSJ Blogs 07/31/2012 | Read Article: WSJ Blogs | Wrongful Death | | | Cyclist's Death Blamed on City, Road Conditions | | The city of Oakland has been sued over the death of a cyclist who was hit by a car after falling from his bike on Grizzly Peak Blvd. The man fell off his bike after his front tire caught in a large rut in the middle of the road; the suit claims the city knew the road was in "dangerous disrepair," but did nothing to improve it. According to the suit, local organizations had been asking the city to fix the road for months before the accident occurred. Paul T.
