Judge Allows Sandy Hook Lawsuit to Move Forward | | A judge in Connecticut will not be dismissing a lawsuit filed by the families of Sandy Hook shooting victims against gun manufacturers. Despite Remington Arms Co. and other companies' claims of protection under a federal shield law, Connecticut Superior Court Judge Barbara N. Bellis said that she would not dismiss the lawsuit. In her decisions, Bellis stated "that any immunity [the shield law] may provide does not implicate this courtâ??s subject matter jurisdiction." The lawsuit was filed by the estates of nine of the 26 victims of the 2012 shooting massacre. The lawsuit alleged that the Marine and his wife became ill after living in military housing in Norfolk, Virginia that was infested with mold. According to the attorney for the plaintiffs, the $350,000 award was a "disappointment," as the lawsuit sought $8 million. The award was determined by a federal jury after a two-week trial in U.S. District Court. According to reports, nineteen additional lawsuits have been filed over the mold issue. Woman at Center of Takata Airbag Lawsuit Dies of Injuries | | A woman from Jacksonville, Florida who has been at the center of a Takata airbag lawsuit has died. The woman was paralyzed in an accident less than two years ago when an airbag exploded and injured her. The lawsuit, filed by her family, alleges that the airbag exploded with such force that it broke the woman's back, leaving her a quadriplegic. The lawsuit names as defendants Honda Motor Company, Duval Motors of Jacksonville and Takata, the manufacturer of the airbag. Takata has been involved in countless lawsuits over incidents involving its recalled airbags. Eileen Kelley, Florida Times Union 04/13/2016 | Read Article: Florida Times Union | $13M Awarded to Woman in Lowe's Injury Lawsuit | | A woman has been awarded $13 million in her lawsuit against Lowe's over a fall at one of their Las Vegas stores. The woman alleged that she was seriously injured when she slipped and fell on a â??slimy, wet substanceâ?? substance on the floor in July 2013. According to the complaint, the woman suffered a skull fracture and a hemorrhage at the front of her brain. As a result of the incident, she "suffered chronic neck pain and headaches, increased anxiety and depression, issues with balance and has forever lost her senses of taste and smell." It was lodged in her aorta. Wilson replied that she understood it was a stent. For 7 years, Wilson had no idea that an 8-inch-long piece of plastic tube was mistakenly left in her, she has claimed in a suit against the hospital. In 2014, Parkland doctors told Wilson about the catheter. By then, it had calcified and moved, posing a potentially life-threatening danger. Now, she might have to live with the catheter for the rest of her life because there may be no safe way to remove it. Naomi Martin, The Dallas Morning News 04/18/2016 | Read Article: The Dallas Morning News | Lawyers for USAA Sanctioned by Federal judge for 'Improper Conduct' | | A federal judge in Ark will place nonmonetary sanctions on lawyers for USAA as well as those representing thousands of its members, according to the San Antonio Express-News. The action was taken after the judge found elements of "collusion" in settlement negotiations that "benefited everyone but" the members who sued the company. Chief U.S. District Judge P.K. Holmes III ruled Thursday that the attorneys violated the judicial process by using the federal court system as a "bargaining chip," the Express-News reported. USAA members sued the insurer over homeowners insurance practices in 2013 in Polk County Circuit Court in Arkansas. USAA moved the case to federal court in 2014. GM said Friday that it would issue a recall for 2014 and 2015 model-year Chevrolet Silverado and GMC Sierra 1500 pickup trucks. The recall covers more than a year's worth of volume of GM's most popular vehicle, the Silverado, and its sister truck. In the U.S., the recall covers 895,232 units.
