Maryland Police Settle Wrongful Arrest Suit

Maryland State Police have agreed to pay $385,000 to settle a lawsuit with the pro-life group Defend Life over 18 arrests in 2008 during a protest. A federal judge ruled lat year that the officers had "unquestionably restricted" the free-speech rights of the protestors and arrested them under false pretenses. 4 Former NFL Players Cite New Orleans’ Bounty System in Latest Lawsuit

The four former NFL players who sued the league on Monday in a state court in Atlanta could be leading a wave of new lawsuits that cite the New Orleans Saints’ bounty system for hard hits as evidence that pro football didn’t properly protect its players from concussions. Legal experts and trial attorneys say they expect more complaints against the NFL to point to the Saints’ scandal after the ex-players filed suit contending the bounty system was another example that the league “explicitly relied on violence” and neglected to educate players on the dangers of concussions.  Associated Press, The Washington Post  04/17/2012

More American Workers Sue Employers for Overtime Pay

Since the height of the recession in 2008, more workers across the nation have been suing employers under federal and state wage-and-hour laws. The number of lawsuits filed last year was up 32% vs. 2008, an increase that some experts partly attribute to a post-downturn austerity that pervaded the American workplace and artificially inflated U.S. productivity. At High Court, Big Pharma Finds Overtime Case a Tough Pill to Swallow

In arguments Monday in the U.S. Supreme Court, the pharmaceutical industry warned of "massive retroactive liability" if their sales representatives are not exempt from federal overtime pay requirements. In Christopher v. SmithKline Beecham, the justices took up the question of whether pharmaceutical sales reps, who promote but do not sell their company's drugs to doctors, are "outside salesmen" exempt from minimum wage and overtime pay requirements in the Fair Labor Standards Act (FLSA).  Marcia Coyle, The National Law Journal - $$ Subscription Required  04/17/2012

Diabetes Supply Co. Fined for Defrauding Medicare

The diabetic supply firm AmMed Direct has agreed to pay $18 million in penalties for allegedly defrauding Medicare. According to the complaint, the company used a bait-and-switch scheme to improperly bill Medicare for diabetes testing supplies and other products. The whistleblower responsible for the original lawsuit against AmMed will receive roughly $2.8 million.  Randy McClain, Tennessean  04/13/2012

Refinery Explosion Prompts Wrongful Death Suit

A wrongful death lawsuit has been filed against Valero over an explosion at a Memphis oil refinery that killed one person and injured others. The suit, filed by two brothers involved in the blast, claims "there was a failure to ensure that there were no hazardous or flammable gases in a flare line" that led to the explosion.  Wire Report, Houston Chronicle  04/16/2012
