Eastern District: Reputation May Have Outlived Reality

The Eastern District covers 43 Texas counties and has a reputation with patent holders as being pro-plaintiff in intellectual property disputes. Judges there also have procedures in place that lawyers say fast-track patent cases. But lawyers say that reputation may have outlived reality. A new trend is showing judges and juries in the Eastern District are not nearly as plaintiff-friendly as previously believed. A review of 36,000 completed patent cases filed nationwide between 2000 and 2013 found that plaintiffs in East Texas lose just as often as they win. The study, issued last month by Lex Machina, a California-based supplier of legal data, found that plaintiffs won their cases either through summary judgment or jury verdict 2.43 percent of the time, while defendants won 2.45 percent. The vast majority were either settled or dismissed.

That gap, say security experts, can amount to crucial lost time for people who might want to protect themselves by monitoring transactions, changing passwords or alerting other relevant parties - such as a credit card company - that the risk of fraud or identity theft is elevated.

Mo. Residents File Suit Against Ferguson Police

A group of Missouri residents have filed a lawsuit alleging that Ferguson police officers used excessive force and made false arrests during the recent protests over the shooting death of Michael Brown. The lawsuit includes incidents of plaintiffs being sprayed with chemicals and tear gas, as well as being hit with rubber bullets and stun grenades. The lawsuit contends that the protesters were not being aggressive and were in surrender position when the police attacked them. The lawsuit alleges that the plaintiffs were humiliated by the incidents. The filing seeks millions in damages.

Widow Files Lawsuit Over Man's Death After Flight

The widow of a man who died shortly after landing at O'Hare International Airport has filed a lawsuit against American Airlines. The lawsuit, filed this week in Cook County court, alleges that the man informed flight attendants that he was having chest pains during the flight, but they did not do anything to provide him with "potentially life-saving medical attention." The lawsuit contends that the airline "failed to exercise the highest degree of care and caution." It alleges wrongful death and negligence and is seeking compensation.
