Judge Clears Path for PACER Overcharge Suit |
A U.S. Court of Federal Claims judge on Monday denied the governmentâ??s request to toss out a class action alleging that a computer glitch caused the Public Access to Court Electronic Records, or PACER, system to incorrectly calculate charges for viewing case docket information.Judge Thomas Wheeler rejected the governmentâ??s argument that users are required to go through an administrative complaint process before suing. Language about the complaint process in PACERâ??s user manual doesnâ??t say that a user forfeits his or her right to get money back if they donâ??t submit a claim, the judge wrote.
