Judge Rules in Favor of Union Pacific in Summary Judgment
 
A federal judge has ruled in favor of the Union Pacific Railroad in a personal injury lawsuit. The lawsuit was filed by a former employee who alleged that a hostile work environment and age-based discrimination forced him to take a medical leave of absence. In addition, the lawsuit alleged that the stressful working environment caused the plaintiff to develop diabetes. However, on August 25, U.S. District Judge Alan Johnson ruled in favor of the railroad stating that the plaintiff was â??stretching and twisting facts in order to survive summary judgment.â??

Trucking Co. Hit With $2.75M Verdict After Fatal Accident

A federal jury in Illinois on Monday awarded $2.75 million to the estate of a deceased truck driver who was killed after crashing into the back of another tractor trailer, finding that the driver of the other vehicle and his employer JBS Carriers Inc. were 55 percent responsible for the incident. After a multi-day trial, a jury found that the estate of Hasib Karahodzic should be awarded 55 percent of the $5 million it sought in its negligence suit against JBS and individual defendant Orrentio Thompson.

Volvo Car Seat Safety Suit Over Child's Death To Be Retried

Strict product liability claims in a suit against Volvo and child car seat manufacturer Graco over the automobile accident death of an infant can be retried, a Pennsylvania appeals court ruled Friday, finding the jury should not have considered evidence that the companies passed certain vehicle safety standards. A Pennsylvania Superior Court panel ruled that Mark Webb is entitled to a new trial on his claims for strict product liability against Volvo Cars of North America LLC and Graco Childrenâ??s Products Inc.

Judge Warns Lawyers He May Impose Sanctions
 
Chief U.S. District Judge Clay Land of the Middle District of Georgia issued a ruling in connection with hundreds of consolidated cases he oversees concerning a â??vaginal meshâ?? device made by Johnson & Johnson unit Mentor Corp. Land, said in his Sept. 7 ruling that heâ??s â??had to waste judicial resources deciding motions in cases that should have been dismissed by plaintiffsâ?? counsel earlierâ??cases that probably should never have been brought in the first place. Enough is enough.â?? From now on, he warned, he would impose sanctions, including possible money penalties, when dismissing such flimsy cases.

As More Devices Board Planes, Travelers Are Playing With Fire

The Federal Aviation Administration, citing fire hazards, has warned against using Samsung Galaxy Note 7 smartphones on aircraft. Three Australian airlines and the German carrier Lufthansa have outright banned their use onboard. The problem is lithium-ion batteries, which have become the standard for portable consumer electronics, including phones, tablets and laptops, because of the power they can pack into a small package. They are also highly volatile.
