Suit Filed Against Maker of FiveFingers Running Shoes

A lawsuit has been filed against the maker of the FiveFingers running shoe, accusing the company of false claims about the health benefits the shoes provide. The lawsuit disputes the claims that the shoes improve posture and muscle strength, and say runners who use the shoes may be at higher risk of injury. Last year, Reebok International Ltd. settled a similar lawsuit against claims about the company's line of toning shoes.  Michael B. Farrell, Boston Globe  03/30/2012

Pastor Accused of Affair with Church Member's Wife

A lawsuit has been filed against the pastor of one of the largest churches in Nashville, claiming the pastor slept with the wife of one of the church members. According to the suit, the couple engaged in pastoral counseling with Bishop Joseph Walker III in 2000, and shortly thereafter Walker began having an affair with the plaintiff's wife. The affair, which allegedly lasted four years, led to the couple's divorce, the suit says. A similar lawsuit has been filed against Walker, alleging sexual misconduct with another church member.  Bob Smietana, Tennessean  03/29/2012

Justice Department Explores Possible Investigation of Parkland

U.S. Justice Department officials are weighing whether to investigate potential civil rights violations of psychiatric patients at Parkland Memorial Hospital. The U.S. attorney for the Northern District of Texas, said the review stems from news stories in The DMN exposing cases of neglect, violence and questionable deaths. Meanwhile, Dallas County’s medical examiner, Dr. Jeffrey Barnard, has changed his conclusion about a death in the psychiatric emergency department. This week, Barnard certified the manner of patient George Cornell’s February 2011 death as “undetermined” after initially finding he died of natural causes.  MILES MOFFEIT and BROOKS EGERTON , The Dallas Morning News  03/30/2012

False Mammogram Results Led to Death, Suit Says

The death of a Georgia woman from breast cancer has prompted a lawsuit against Perry Hospital and a former radiology technician who allegedly reported negative results for mammograms when they were actually positive. According to the suit, the woman had a mammogram at the hospital between 2008 and 2009 and was given normal results, when in fact she had metastatic breast cancer. By the time the error was caught more than a year later, her cancer had developed beyond treatment, and the woman ultimately died. The suit is seeking damages of up to $10,000, as well as punitive damages to be determined by a jury.  Becky Purser , Macon Telegraph  03/30/2012

Settlement Reached in California Taser Death

Stanislaus County, Calif., has agreed to settle a wrongful death lawsuit with the family of a Modesto, Calif., man who was tased to death by officers in a local jail. The man got into a struggle with deputies while being moved to another cell when he was shot multiple times with Tasers. Medical records show he died shortly thereafter of hypertensive heart disease.
