Lawsuit Blames Temple-Inland for Guaranty Bank Collapse

A lawsuit accuses Austin-based Temple-Inland Inc. of causing the 2009 failure of Guaranty Bank by burdening the bank with risky securities and "fraudulently looting" assets worth more than $1 billion. The lawsuit was filed in federal court in Dallas by Kenneth Tepper, a trustee who represents the failed bank's creditors and the Federal Deposit Insurance Corp. The suit seeks more than $1 billion in damages from Temple-Inland and names a number of former and current executives and directors of Temple-Inland and Guaranty Bank.  Barry Harrell, Austin American Statesman  08/24/2011

Match.com Settles Suit with Assaulted Woman

Dating service Match.com has agreed to settle a lawsuit with a woman who was attacked by a man she had met on the Website who had previous sexual offenses. As part of the settlement, the company has agreed to "conduct background checks on all members to screen out known sex offenders." The man who attacked the plaintiff faces up to a year in prison and five years probation if convicted.  Carol J. Williams, LA Times  08/24/2011

KBR Wants Losing Rape Claimant to Pay Co’s Legal Fees

KBR wants Jamie Leigh Jones, the Houston woman who claimed that she was raped while working in Iraq for defense contractor KBR, to pay for its legal fees and court costs.n its motion seeking to recover more than $2 million in fees, KBR alleged that Jones’ rape and hostile work environment claims were fabricated and frivolous. The company has also requested that she cover its court costs of $145,000. In a reply brief, Jones countered that there is “nothing frivolous” about her claims, as evidenced by the fact that the judge agreed to let her proceed to trial and the jury deliberated for more than 10 hours before reaching its verdict.  Nathan Koppel (blog), Wall Street Journal - $$ Subscription Required  08/24/2011

Judge Orders Ind. to Preserve Fair Stage Wreckage

An Indiana judge ordered the state to preserve the wreckage from a stage collapse at the State Fair that killed seven people. LaPorte County Judge Thomas Alevizos said in his two-page ruling that he was issuing a "rather limited" preliminary injunction directing the state to follow the protocols put forth by the engineering firm the state has hired to investigate the collapse, in which strong winds toppled the stage onto a crowd on Aug. 13 as they waited for country band to perform.  Associated Press, Houston Chronicle  08/24/2011

Judge Tosses Suit Against Penn. School District

A U.S. District Judge has dismissed a lawsuit against the North Allegheny School District in Pennsylvania over the rape of a female student in a school parking lot. The lawsuit claimed school officials "were indifferent to security issues and responded slowly" to the incident. The judge, however, found that school officials "took immediate action" upon learning of the event, and did not create the danger that led to the rape.  Staff Report, Pittsburgh Post-Gazette  08/23/2011

Suit: Hotel Printed Private Credit Card Information

A Maryland man has filed a lawsuit against a Virginia Beach hotel for allegedly providing private information on his credit-card receipt. The suit, which is seeking class-action status, references a 2003 law passed by Congress that forbids merchants from printing card expiration dates on receipts. A willful violation of that law can trigger damages of up to $1,000 per offense.  Tom Shean, Virginian Pilot  08/24/2011

Wrongful Death Suit Against Cop Reinstated

A federal appeals court has reinstated a wrongful death lawsuit filed against a Madera, Calif., police officer who shot a man in the chest with her pistol, believing it to be her Taser. The man was handcuffed in the back seat of the officer's patrol car when the incident occurred. The appeals court said the officer had acknowledged the man posed no danger to anyone but himself, and that a jury might even question the use of a Taser in the situation, let alone a gun.  Bob Egelko, San Francisco Chronicle  08/23/2011

Nurses at Risk for Accidental Exposure to Chemo Drugs: Study

Accidental exposure to highly toxic chemotherapy drugs is common among cancer nurses in the US, a new study finds. Researchers surveyed 1,339 oncology nurses in one state who work in outpatient chemotherapy infusion centers and found that nearly 17% said their skin or eyes had been exposed to the drugs. In the United States, about 84% of chemotherapy is delivered in outpatient clinics. Accidental chemotherapy exposure can harm the nervous and reproductive systems and increase the risk of blood cancers, according to the study authors, from the University of Michigan Comprehensive Cancer Center.  HealthDay, Yahoo News  08/24/2011
